If I file an accident claim will I have to go to court?

It depends. In many cases, you are able to resolve your claim without having to go to court in a trial, but in some cases, the trucking company or the defendant is not serious about resolving the case, so you will have to file a lawsuit and perhaps go to a trial before a jury or a judge. I think the best thing to do is to not assume that you will be able to resolve the case without going to court. You should assume that there’s a very good possibility that you will have to go to court and just take action accordingly.
